AFC ASIAN CUP DREAM XI FAN VOTING CONTEST TERMS & CONDITIONS

Please read these terms and conditions for the AFC Asian Cup Dream XI Fan Voting Contest (the “Contest”) prior to participating (the “Contest Terms”). 

 

By participating in the Contest, you hereby agree to be bound by these Contest Terms (and any amendments thereof) and represent and warrant that you satisfy all of the eligibility requirements set out herein.

 

This Contest is organised by the Asian Football Confederation (“AFC”) in relation to the AFC Asian Cup Qatar 2023™ (“Competition”). Any queries relating to the Contest shall be directed to the AFC only at asiancup.contest@the-afc.com.

 

1.1.             Entry to the Contest is open to all individuals who are eighteen (18) years of age and above as of 12 July 2023 (each, a “Participant”). Participants should be aware that a breach of this age requirement will result in the participant being automatically disqualified.

1.2.             Directors, officers, employees and committee members of the AFC, its commercial partners, agents, external service providers (related to this Contest) and immediate families of each respective party are not eligible to participate in the Contest.

1.3.             The contest is open to parties who reside in countries where entry in prize competitions of the nature set out herein is not a breach of their respective local laws.

 

2.1.             To participate in the Contest, Participants are required to register an account at www.the-afc.com/dreamXI (the “Website”) with the following information (each such registration, an “Account”):

 

(a)   first and last name;

(b)   email address; 

(c)   country of residence; and

(d)   such other information as requested by the AFC.

 

2.2.             Each Participant shall only be allowed to participate once using only one (1) registration Account. The AFC reserves the right to disqualify a Participant if it is found that Participants are the same individual who has participated multiple times using multiple different Accounts. 

2.3.             All details provided by the Participants during registration must be true, accurate and complete. 

2.4.             The use of third-party data, names or nicknames which are considered indecent and/or offensive is strictly prohibited.

2.5.             Participants shall be solely responsible for all activities conducted on their respective Account and shall ensure that all Account details are kept confidential to avoid misuse or abuse by any third parties. 

3.1.             The Contest shall be organised from 00:00, 12 July 2023 to 23:59, 30 July 2023 in accordance with Greenwich Mean Time (“Contest Period”).

3.2.             Participants may register at any time during the Contest Period. 

 

4.1.             Participants will be required to vote for their all-time eleven (11) players of the AFC Asian Cup using the shortlist and voting criteria provided within the Website. Participants will be required to share a graphic of their Dream XI on at least one (1) of their social media platform (i.e. Facebook, Instagram, Twitter, Weibo, Toutiao, etc.) with the hashtag “#AsianCupDreamXI”.

4.2.             Each selection of eleven (11) players submitted by the Participant on the Website as part of the Contest, and shared by the Participant on his/her social media handle with the hashtag “#AsianCupDreamXI” will be considered an “Entry”. All Entries must be submitted before the end of the Contest Period. 

4.3.             Participants may not be permitted to change their Entry once submitted. Participants will only be entitled to submit one (1) Entry from their registered given Account. 

4.4.             Any Entries received after the Contest Period will not be entertained. AFC shall not be responsible for Entries received late or lost in transmission due to any reasons.. Participants are therefore encouraged to register and submit their Entries well before the published deadlines.

 

5.1.             The collective fan vote for the Contest will be combined with the votes of a panel of football experts (selected by the AFC at its sole discretion) to decide the final Dream XI of the AFC Asian Cup (the “Final Dream XI”). 

5.2.             Participants will be ranked on the basis of the number of players in their Entry matching the players in the Final Dream XI. The Participant with the highest number of matching players in their Entry will be ranked highest. 

5.3.             If two (2) or more Participants have an equal number of matching players in their Entry, then the earlier of such Participants to have submitted their Entry during the Contest Period will be ranked higher. By way of example, if Participant A has eleven (11) matching players to the Final Dream XI in their Entry and has submitted the Entry on 13 July 2023, and Participant B has eleven (11) matching players to the Final Dream XI in their Entry and has submitted the Entry on 15 July 2023, then Participant A will be ranked higher than Participant B, since Participant  A’s Entry was submitted earlier during the Contest Period (i.e., 13 July 2023).  For purposes of clarity, the day when the Entry is submitted will be in accordance with Greenwich Mean Time.

5.4.             No leader board showing the rank of each Participant will be publicly made available by the AFC. The AFC reserves the right to rank the Participants based on the criteria set out above and no correspondence or objections in this regard will be entertained. The decision of the AFC in this regard will be final. 

 

6.1.             The Participant who is ranked highest (i.e., no.1) based on the ranking criteria set out in Clause 5, will be declared the winner of the Contest (“Winner”). 

6.2.             The AFC reserves the right to select the Winner based on the ranking criteria set out in Clause 5. The decision of the AFC will be final, and no correspondence will be entered into with any Participants in this regard. Should the Entries in any category fall below the standard required by the Contest, then the AFC reserves the right not to declare any winner.

6.3.             The Winner will be contacted by the AFC by email, on the email address submitted as part of the Account registration process. 

6.4.             The AFC reserves the right to declare additional winners of the Contest on the basis of the ranking criteria set out in Clause 5 and award such additional winners such prizes as the AFC may determine in its sole discretion. The AFC’s decision in this regard shall be final and binding on all Participants.

 

7.1.             The Winner will be awarded the following, for use by himself/herself and their chosen guest (collectively the “Prize”):

(a)   up to two (2) non-VIP tickets for the opening match of AFC Asian Cup Qatar 2023™, i.e. Qatar vs Lebanon kick-off 19:30 local time;

(b)   up to two (2) economy class flight tickets to  Doha, Qatar, if the Winner resides outside of Qatar. For purposes of clarity, the flight dates and times will be determined by the AFC and no request for changes to the flight dates or times can be made by the Winner; and 

(c)   three (3) nights' accommodation for up to two (2) persons in one (1) room in a 4-star hotel (subject to availability) in the city in Qatar where the opening match of the AFC Asian Cup Qatar 2023 will be held, if the Winner resides in a city other than the city where the opening match is held.

7.2.             The Prize and its elements as listed in Clause 7.1 above will be subject to the following conditions:

(a)   the Winner and their guest must submit such documentation as may be required by the AFC in order to verify identities of the individuals and to make the required bookings for the Prize elements;

(b)   the Winner must submit proof of having shared his/her Entry on his/her social media handle (for the avoidance of doubt, failure to provide such proof shall result in the Prize being forfeited, and the AFC may select an alternate winner at its sole discretion);

(c)   if the Winner does not invite a guest, then the AFC will provide the Prize elements for the Winner only, and the Prize elements which are intended for the guest will be forfeited; 

(d)   all travel and accommodation are subject to availability. If any class of travel, mode of travel or class of accommodation is not available, then the AFC reserves the right to determine and provide an alternative class of travel, mode of travel or class of accommodation, as determined in the AFC’s sole discretion; 

(e)   any costs incurred in relation to the Prize elements shall be incurred at the Winner’s and their guest’s expense, including without limitation with respect to airport transfers, local transportation, meals, hotel room service, hotel room security deposit, laundry service, alcoholic beverages, merchandise, souvenirs, local and long distance telephone calls, mobile and data roaming, tips, service charges, taxes, and all other charges which relate to any items which are not the Prize elements specifically described in Clause 7.1; 

(f)    travel insurance is not included. The Winner and their guest will be responsible for arranging adequate travel insurance before travelling as per their needs and for the entire duration of the Prize. The AFC will not be liable for any costs or losses through the Winner’s and their guest’s failure to take out adequate insurance cover; 

(g)   the Winner and their guest will be responsible for their own passports, visa requirements and any other documentation and requirements at the port of departure or the port of arrival, and any medical and security clearances including COVID-19 testing (if required), requirements and/or protocols; 

(h)   the Winner and their guest will be required to travel on the same routing; and

(i)     the Prize elements will be subject to the Winner and their guest complying with all local laws, regulations and requirements. The AFC will not be liable in any way for any failure by the Winner or their guest to do so. 

7.3.             The Prize shall not be transferable or redeemable for cash. 

7.4.             No substitution of the Prize shall be allowed except that the AFC may, at its sole discretion, substitute any element of the Prize at any time. 

7.5.             The Prize cannot be used in conjunction with any other promotion or offer.

7.6.             The Prize has to be validly claimed by the Winner within seven (7) calendar days from when the AFC contacts such Winner (as described in Clause 6.3), after which the Prize will be forfeited, or at the AFC’s discretion, an alternate winner will be selected.

7.7.             Due to applicable local laws (without prejudice to the provisions of Clause 1.3) the AFC may not be able to award the Prize to a Winner who is unable to utilise the Prize, including those who are unable to enter into the country or city where the AFC Asian Cup Qatar 2023™ is located. In such cases, the Prize shall be forfeited, or substituted with other prizes at the AFC’s sole discretion. The AFC’s decision in this regard will be final and binding on the Winner. 

                

8.1.             We may share your personal data with affiliates of the AFC or with other third parties for administrative purposes, business purposes, and/or for cross-promotion. This may involve the storage, use, disclosure or other processing, or transfer of your personal data out of Malaysia or within Malaysia. Third parties receiving your personal data will be bound by requirements under the applicable Personal Data Protection legislation. 

8.2.             By participating in this Contest, you hereby consent to: (a) the collection, use, disclosure, transfer, and processing of your personal data for the purposes of: (i) administering the Contest and selecting the Winner; and (ii) consumer research, marketing and promotions; (b) the AFC’s privacy policy (available at https://www.the-afc.com/en/more/privacy_policy.html) and the AFC’s Personal Data Protection Notice (PDPA) (available at: http://assets.the-afc.com/Misc/ACL2022_Quiz_PDPA.pdf); and (c) the AFC’s terms of service (available at https://www.the-afc.com/en/legal/terms__conditions.html). 

 

9.1.                By entering the Contest, each Participant agrees to be bound by these Contest Terms and by decisions of the AFC, which are final and binding as to all Contest-related matters. 

9.2.                By entering this Contest and/or accepting any Prize you may win, you agree that: (a) you have all rights, permissions and consents necessary to grant the rights to AFC as expressed herein; (b) you will abide by and be bound by the Contest Terms and the AFC’s decision and any policies in relation thereto; (c) you  release and hold harmless the AFC, its commercial agents and suppliers, and their respective officers, directors, shareholders, employees, agents or representatives from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from your entry submission, the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any Prize; participation in the Contest or any Contest-related activity or from any interaction with, or downloading of, computer Contest information.

9.3.             The Prize is awarded on an ‘as is’ basis and shall be without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose) and the AFC does not make any representation, warranty, or guarantee, express or implied, relating to the Contest or the Prize. 

9.4.             A Winner’s acceptance of a Prize constitutes the grant to AFC of an unconditional right to use, and authorise the AFC’s commercial partners to use, the winner's name, profile, image, voice, video, likeness, photograph, biographical, and prize information and/or statements about the Contest for any programming, publicity, advertising, marketing and promotional purposes without compensation, except where prohibited by law.

9.5.             In the event of circumstances beyond the reasonable control of the AFC such as without limitation viruses, bugs, unauthorized human intervention, acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism , pandemic, epidemic, situations beyond control that would affect the security, fairness or proper play of the Contest, so that it cannot be conducted as originally planned, except where prohibited by law, the AFC has the right, in its sole discretion, to modify these Contest Terms or to cancel, modify, terminate or suspend the Contest; and in such event, to select the Winner by such method as the AFC may in its sole discretion consider equitable. 

9.6.             By participating in the Contest, each Participant agrees that: (a) the AFC shall not be responsible for typographical or other errors in the offer or administration of this Contest, including without limitation any errors in the advertising, Contest Terms, selection of the Winner, and distribution of the prize; (b) any portion of any Prize not accepted or used by a Winner will be forfeited; (c) the AFC  is not responsible for any inability of a Winner to accept or use a Prize (or any portion thereof) for any reason; and (d) the AFC shall not be liable financially in any aspect to the Winner and the Participants. The Participant also agrees that they shall not make the following statements regarding the AFC and/or the contest: (a) make inappropriate, illegal or offensive statements regarding the AFC and/or the Contest, (b) make religiously, culturally or politically insensitive statements, (c) defamatory or libellous statement, and (d) statements likely to tarnish the image and reputation of the AFC, its competition and stakeholders.

9.7.             The AFC has the right, at any time and at its sole discretion, to disqualify any individual it suspects to be doing any of the following: (a) tampering or attempting to tamper with the entry process or the operation of the Contest or the Application; (b) violating the Contest Terms; (c) violating the terms of service or other terms, conditions of use and/or general rules or guidelines of any AFC website, property or service; (d) acting in an unsportsmanlike, unethical or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or (e) for any other good cause as determined solely by the AFC.

9.8.             As any attempt by any individual to damage the application or undermine the legitimate operations of this Contest or the application is a violation of these Contest Terms as well as criminal and civil laws, and should the AFC believe or become aware that such an attempt has been, is being, or will be made, it has the right to seek remedies and damages from any responsible individuals to the fullest extent permitted by law, including without limitation criminal prosecution.

9.9.             This Contest is governed in accordance with the laws of Malaysia. All disputes, claims and causes of action at law or in equity (individually, “Claim”) arising out of or relating to this Contest, the meaning or interpretation of the Rules or any prize awarded shall be resolved by applying the laws of Malaysia, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts within Malaysia.

9.10.         All claims shall be resolved individually, without resort to any form of class action and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event include attorneys’ fees, and under no circumstances will any participant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses and waives all rights to have damages multiplied or otherwise increased.

9.11.         The AFC has the right to modify Prize award procedures at its sole discretion and shall not be responsible for the cancellation, postponement, or unavailability of any Prize, and if such occurs, the Prize may be substituted with an alternate prize (as determined by the AFC in its sole discretion).

9.12.         The AFC is not responsible for any changes to any function that may interfere with the Contest or your ability to timely participate in the same.

9.13.         The AFC is not responsible for any failure of delivery of Winner notification.

9.14.         The AFC reserves the right at any time in its absolute discretion and without prior notice to: (a) to cancel, modify, suspend or delay the Contest; (b) to make changes to these Contest Terms, whereupon all Participants be bound by the terms and conditions as varied by the AFC; and/or (c) to substitute, withdraw or cancel any Prize without disclosing any reason thereof and without any payment or compensation whatsoever. 

These Contest Terms have been prepared in the English language, which language shall govern the interpretation and construction of these Contest Terms. Any translation of these Contest Terms shall be for reference purposes only, and the English language version shall always prevail in the case of any inconsistencies between the English language version and any translations thereof.
