STANDARD TERMS AND CONDITIONS – AFC SOCIAL MEDIA CONTESTS AND FAN ENGAGEMENT CAMPAIGNS

These standard terms and conditions shall apply to all contests and fan engagement campaigns (collectively, the “Contests” and each a “Contest”) organised by the Asian Football Confederation (the “AFC”) in relation to association football and futsal competitions organised and conducted by the AFC (collectively the “Competitions” and each a “Competition”). By participating in any Contest, you hereby agree to be bound by these terms and conditions and any amendments thereof (the “Contest Terms”) and represent and warrant that you satisfy all of the eligibility requirements set out herein. These Contest Terms shall be read in conjunction with the contest rules and mechanics for each Contest (the “Contest Rules”) which shall be made available on www.the-afc.com (the “Website”) and the ‘AFC Live’ app (the “AFC App”), which shall be deemed to be incorporated by reference herein.

Any queries relating to the Contests, the Contest Rules or these Contest Terms shall be directed to the AFC by email only at [contests@the-afc.com] and each such query must mention the name of the relevant Contest clearly in capital letters in the subject line.

1. ELIGIBILITY

1.1. Entry to the Contests is open to all individuals (each, a “Participant”), however any Participant below eighteen (18) years of age as of the date on which the Contest Period commences (as specified under the relevant Contest Rules) confirms that he/she has obtained the consent of their respective parent/guardian to participate in this Contest. The AFC reserves the right to verify such consent from the respective parent/guardian at any time. Participants should be aware that a breach of this consent requirement (where applicable) will result in the Participant being automatically disqualified.

1.2. Directors, officers, employees, and committee members of the AFC, its commercial partners, agents, external service providers (related to this Contest) and immediate families of each respective party are not eligible to participate in the Contests.

1.3. Contests are open to parties who reside in countries where entry in prize competitions of the nature set out herein is not a breach of their respective local laws.

2. ACCOUNT REGISTRATION

2.1. To participate in a Contest, Participants are required to register their details on the relevant Contest portal on the Website or the AFC App and provide the information requested therein, including the following(each such registration, an “Account”):

(a) first and last name;

(b) email address;

(d) place of residence; and

(e) such other information requested by the AFC.

2.2. Each Participant shall only be allowed to participate in a given Contest only once using only one (1) registration Account. The AFC reserves the right to disqualify a Participant if it is found that Participants are the same individual who has participated multiple times using multiple different Accounts.

2.3. All details provided by the Participants during registration shall be accurate and complete.

2.4. The use of third-party data or nicknames which are considered indecent and/or offensive is strictly prohibited.

2.5. Participants shall be solely responsible for all activities conducted on their respective Account and shall ensure that all Account details are kept confidential to avoid misuse or abuse by any third parties.

3. CONTEST PERIOD

3.1. Each Contest shall be organised during the period specified in the relevant Contest Rules for that Contest (the “Contest Period”). Participants must note that these dates may be subject to change at the AFC’s sole discretion, taking into consideration the actual schedule of Competitions.

3.2. Participants may register by creating an Account at any time during the relevant Contest Period, in accordance with the relevant Contest Rules. Further, any submissions which Participants wish to make in relation to a given Contest must be submitted prior to any relevant deadlines for that Contest as specified in the relevant Contest Rules (“Deadlines”).

3.3. Any Account registrations which are received after the relevant Contest Period and any submissions in relation to a given Contest which are received after the relevant Deadlines will not be entertained or considered.

3.4. The AFC shall not be responsible for Account registrations or submissions for a given Contest which are received late or lost in transmission due to high online traffic levels. Participants are therefore encouraged to register their Accounts and make their Submissions for a given Contest well before the published Deadlines.

4. CONTEST MECHANICS

Full details relating to the mechanics of a given Contest are specified in the relevant Contest Rules available on the Website and the AFC App.

5. SELECTION OF WINNERS

5.1. Winners will be determined by the AFC (in its sole discretion) on the basis of the criteria set out in the relevant Contest Rules (each a “Winner”).

5.2. The decisions of the AFC in with regards to selection of the Winners shall be final and binding on all Participants, and no correspondence will be entered into with any Participants disputing the AFC’s decisions. Should the submissions for any Contest fall below the standard required by the AFC for such Contest (as determined by the AFC in its sole discretion), then the AFC reserves the right not to select any Winners for such Contest.

5.3. All Winners will be contacted by the AFC by email, on the email address submitted as part of the Account registration process.

5.4. The AFC reserves the right to declare additional winners of the Contest based on the criteria set out in the relevant Contest Rules and award such additional winners such prizes as the AFC may determine in its sole discretion. The AFC’s decision in this regard shall be final and binding on all Participants.

6. PRIZES(S)

6.1. Winners shall be respectively awarded the prizes specified under the relevant Contest Rules (the “Prizes”).

6.2. Prizes shall not be re-sold, exchanged, or transferred.

6.3. All Prizes and their respective individual elements shall be subject to the following conditions (as and where applicable):

(a) The relevant Winner must submit such documentation as may be required by the AFC in order to verify identities of the individuals and to make any required bookings or reservations for any Prize elements;

(b) Any travel and accommodation awarded as a Prize shall always be subject to availability. The class of travel and accommodation shall be determined by the AFC in its sole discretion. If any class of travel, mode of travel or class of accommodation is not available, then the AFC reserves the right to determine and provide an alternative class of travel, mode of travel or class of accommodation, as determined in the AFC’s sole discretion;

(c) Any costs incurred in relation to the Prize elements shall be incurred at the Winner’s sole expense, including without limitation expenses to airport transfers, local transportation, meals, hotel room service, hotel room security deposit, laundry service, alcoholic beverages, merchandise, souvenirs, local and long distance telephone calls, mobile and data roaming, tips, service charges, taxes, and all other charges which relate to any items which are not the Prize elements specified in the relevant Contest Rules (as applicable);

(d) Travel insurance or any other insurance of any kind is not included in any Prize. Where relevant and applicable, the Winner will be responsible for arranging adequate travel insurance before travelling as per his/her needs and for the entire duration of the relevant Prize. The AFC will not be liable for any costs or losses arising in connection with a Winner’s failure to take out adequate insurance cover;

(e) The respective Winner will be responsible for his/her own passport, travel insurance, medical insurance, visa requirements and any other documentation and requirements at the port of departure or the port of arrival, and any medical and security clearances including COVID-19 testing (if required), requirements and/or protocols (where applicable); and

(f) All Prize elements will be subject to the Winner complying with all local laws, regulations, and requirements. The AFC will not be liable in any way for any failure by the Winner to do so.

6.4. Winners shall be responsible for any local taxes and any other expenses relating to the prize not specifically mentioned herein and all Prizes shall not be transferable or redeemable for cash.

6.5. No substitution of the Prize shall be allowed except that the AFC may, at its sole discretion, substitute a prize of equal or greater value.

6.6. Prizes cannot be used in conjunction with any other promotion or offer.

6.7. Prizes have to be validly claimed by each Winner within seven (7)) days from when the AFC contacts such Winner (as described in Clause 5.3), after which Prize will be forfeited, or at the AFC’s discretion, an alternate winner will be selected.

6.8. Due to applicable local laws (without prejudice to the provisions of Clause 1.3) the AFC may not be able to award certain Prizes to a Winner who is unable to utilise the Prize, including those who are unable to enter the country or city where the Competition is located. In such cases, the Prize shall be forfeited, or substituted with other prizes at the AFC’s sole discretion. The AFC’s decision in this regard will be final and binding on the Winner.

7. PERSONAL DATA

7.1. We may share your personal data with affiliates of the AFC or with other third parties for administrative purposes and/or business purposes. This may involve the storage, use, disclosure or other processing, or transfer of your personal data out of Malaysia or within Malaysia. Third parties receiving your personal data will be bound by requirements under the applicable Personal Data Protection legislation.

7.2. By participating in this Contest, you hereby consent to: (a) the collection, use, disclosure, transfer, and processing of your personal data for the purposes of administering the Contest and selecting the Winner, and for consumer research, promotional and marketing purposes; (b) the AFC’s privacy policy (available at https://www.the-afc.com/en/more/privacy_policy.html) and the AFC’s Personal Data Protection Notice (PDPA) (available at: https://assets.the-afc.com/Misc/AFC_PDPA.pdf and (c) the AFC’s terms of service (available at https://www.the-afc.com/en/legal/terms__conditions.html).

8. GENERAL CONDITIONS

8.1. By entering a Contest, each Participant agrees to be bound by these Contest Terms, the relevant Contest Rules and by decisions of the AFC, which are final and binding as to all Contest-related matters.

8.2. By entering this Contest and/or accepting any Prize you may win, you agree that: (a) you have all rights, permissions and consents necessary to grant the rights to AFC as expressed herein; (b) you will abide by and be bound by the Contest Terms, the relevant Contest Rules and the AFC’s decision and any policies in relation thereto; (c) you release and hold harmless the AFC, its commercial agents and suppliers, and their respective officers, directors, shareholders, employees, agents or representatives from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from your entry submission, the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any Prize; participation in a Contest or any Contest-related activity or from any interaction with, or downloading of, computer Contest information.

8.3. Prize(s) are awarded on an ‘as is’ basis and shall be without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose) and the AFC does not make any representation, warranty, or guarantee, express or implied, relating to a Contest or Prize.

8.4. A Winner’s acceptance of a Prize constitutes the grant to AFC of an unconditional right to use, and authorise the AFC’s commercial partners to use, the winner's name, profile, image, voice, likeness, photograph, biographical and prize information and/or statements about the Contest for any programming, publicity, advertising, and promotional purposes without additional compensation, except where prohibited by law.

8.5. In the event viruses, bugs, unauthorised human intervention, acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond AFC’s reasonable control, corrupt, prevent or impair the administration, pandemic, endemic, security, fairness or proper play of the Contest, so that it cannot be conducted as originally planned, except where prohibited by law, the AFC has the right, in its sole discretion, to modify these Contest Terms or to cancel, modify, terminate or suspend the Contest; and in such event, to select the Winner(s) by such method as the AFC may in its sole discretion consider equitable.

8.6. By participating in a Contest, each Participant agrees that: (a) the AFC shall not be responsible for typographical or other errors in the offer or administration of this Contest, including without limitation any errors in the advertising, Contest Terms, selection of the Winner, and distribution of the prize; (b) any portion of any Prize not accepted or used by a Winner will be forfeited; (c) the AFC is not responsible for any inability of a Winner to accept or use a Prize (or any portion thereof) for any reason; and (d) the AFC shall not be liable financially in any aspect to the Winner and the Participants.

8.7. The AFC has the right, at any time and at its sole discretion, to disqualify any individual it suspects to be doing any of the following: (a) tampering or attempting to tamper with the entry process or the operation of the Contest or the Application; (b) violating the Contest Terms and/or the relevant Contest Rules; (c) violating the terms of service or other terms, conditions of use and/or general rules or guidelines of any Contest property or service; (d) acting in an unsportsmanlike, unethical or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or (e) for any other good cause as determined solely by the AFC.

8.8. As any attempt by any individual to damage the application or undermine the legitimate operations of this Contest or the application is a violation of these Contest Terms as well as criminal and civil laws, and should the AFC believe or become aware that such an attempt has been, is being, or will be made, it has the right to seek remedies and damages from any responsible individuals to the fullest extent permitted by law, including without limitation criminal prosecution.

8.9. All disputes, claims and causes of action at law or in equity (individually, “Claim”) arising out of or relating to this Contest, the meaning or interpretation of the Rules or any prize awarded shall be resolved by applying the laws of Malaysia, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts within that territory.

8.10. All claims shall be resolved individually, without resort to any form of class action and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event include attorneys’ fees, and under no circumstances will any participant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses and waives all rights to have damages multiplied or otherwise increased.

8.11. The AFC has the right to modify Prize award procedures at its sole discretion and shall not be responsible for the cancellation, postponement, or unavailability of any Prize, and if such occurs, the Prize will be substituted with a prize of equal or greater value (as determined by the AFC in its sole discretion).

8.12. The AFC is not responsible for any changes to any function that may interfere with the Contest or your ability to timely participate in the same.

8.13. The AFC is not responsible for any failure of delivery of Winner notification.

8.14. The AFC reserves the right at any time in its absolute discretion and without prior notice to: (a) to cancel, modify, suspend or delay the Contest; (b) to make changes to these Contest Terms, whereupon all Participants be bound by the terms and conditions as varied by the AFC; and/or (c) to substitute, withdraw or cancel any Prize without disclosing any reason thereof and without any payment or compensation whatsoever.

8.15. All Participants agree to be bound by these Contest Terms and by the decisions of the AFC, which are final and binding in all respects.

8.16. The AFC reserves the right at its sole discretion to disqualify any individual that it determines is tampering with the entry process or the operation of the Contest, engaging in any conduct that is deemed detrimental or unfair to the AFC, the Contest or any other participant, acting in breach or potential breach of these Contest Terms and/or the AFC’s website use and access agreement, or is otherwise ineligible to enter or participate in the Contest. No correspondence and/or objection will be entertained.

8.17. These Contest Terms have been prepared in the English language, which language shall govern the interpretation and construction of these Contest Terms. Any translation of these Contest Terms shall be for reference purposes only, and the English language version shall always prevail in the case of any inconsistencies between the English language version and any translations thereof.

8.18. This Contest is governed in accordance with the laws of Malaysia.
